Abstract

The enforcement of terrorism has become both an international and nationaldemand for Indonesia. The motives behind terrorist actions include religiousfactors, ideology, struggle for independence, seeking liberation from injustice, andspecific objectives. Terrorism constitutes a category of high-risk convicts that endanger national security and public safety. The Super Maximum SecurityPrison is a facility with very strict security measures and individual in mate placement (One man, one cell). The purpose of this research is to understand theregulation and implementation of rehabilitation for high-risk terrorist convicts and the perspective of the Universal Declaration of Human Rights 1948 in ful filling human rights within the convict rehabilitation program at the Class IIA Super Maximum Security Prison in Pasir Putih, Nusakambangan. This research employsa normative-empirical method. The data sources used are primary and secondary data.

Based on the research findings, it is concluded that Regulation No. M.HH-02.PK.01.02.02 of 2017 Regarding Guidelines for the Work of Special Correctional Institutions for High-Risk Convicts in the Terrorist Category and Regulation No.35 of 2018 Regarding the Revitalization of Correctional Administration have notbeen implemented by the regulations related to convict rehabilitation at the PasirClass IIA Super Maximum Security Prison and there are still obstacles. Theinterview results show that the implementation of rehabilitation does not grantremission to convicts, the suboptimal role of correctional officers due to it not beingtheir main job, the obstacle of convicts with tough personalities, and the obstacle ofcorrectional officers lacking expertise in personality development. The perspectiveof the Universal Declaration of Human Rights in granting basic rights to convictshas been provided with limitations, including the right to life, freedom from torture,freedom of religion, freedom of opinion, assembly and association, and the right toparticipate in governance. As a representation of the Indonesian State, the prisonmust Respect, Fulfil, and Protect, which has been fulfilled with very strict limitations due to the security of the Super Maximum Security Prison of Class II A Pasir Putih Nusakambangan.
